It appears that this antenna would be OK for an LPFM, since Section 73.816  
of the FCC Rules permits LPFM stations to use horizontal, vertical, circular, 
or  elliptical polarization.  It would be a problem for a regular FM broadcast  
station, however, since the rules only permit the vertically polarized power 
to  exceed the horizontally polarized power when it is necessary to protect TV 
 stations operating on Channel 6.  The biggest problem I see is that the  
antenna is apparently different from what is specified on the station  license.  
Antenna changes are permitted for LPFM stations as long as the  antenna height 
is maintained within +2/-4 meters of the authorized height and  the ERP 
complies with the presently licensed value, but Section 73.875(c)  of the FCC Rules 
requires that a 319 application to modify the station license  to report the 
antenna replacement be filed within ten days.
