The FCC rules on telemarketing are at
http://www.hallikainen.com/FccRules/2006/64/1200/ . Generally, it is
illegal for someone to call a residential line if that line is on the
national do not call list UNLESS there is an established business
relationship, the caller is a nonprofit, or the call is political (first
amendment concerns here). Commercial callers are required to maintain
their own do not call list (presumably a list of those existing customers
who do not want to receive calls) and not call those people. Further,
telemarketers cannot call cellphones or any similar service where the
person receiving the call is charged for the call.

So... If the telemarketer is commercial, and you do not have an
established business relationship, report them to the FCC. If you do have
an established business relationship, ask them to put you on their do not
call list. The rules regarding telemarketing calls to landline phones
apply to residential lines (not business). The unsolicited fax rules apply
to all lines (residential and business).
