I believe the Code doesn't allow a branch circuit to be subdivided in 
a manner which would include another overcurrent device external to 
the device being powered unless a load center is the dividing device.

Thus, adding a breaker to one phase of a 3 phase box to power a single 
phase circuit is NOT permitted unless that tap takes place in the 
powered device.
