Possibly, the Class C's could move. For many reasons, most of the D's
could not and would not without a court fight unless they were given
class B FM's at the very least. Further complicating the situation,
there are some Class B's that would demand they be allowed to move
if Class C's moved.

What you are suggesting is not politically realistic or practical from
a legal viewpoint without significant rules changes and years in court.
As soon as a situation is created where some receive different treatment
the court doors open and soon after, the wheels fall off the cart.

The general thrust, or at least my intent, has been to say we have
what the FCC has given and it is time to get to work with it and
quit whining over what once was or what might have been because
neither is reality.
